Sidewalk Waiver Requests
According to the Amherst Town Code, sidewalks must be installed along the entire street frontage of any lot at the time the lot is developed, unless waived by resolution of the Planning Board (as a part of site plan or subdivision approval) or by the Town Board (Town Code Part IX, §83-9-1 – §83-9-5). See below for street segments that are exempt from the sidewalk requirement.
Property owners may apply for a waiver of this requirement by completing the application for a sidewalk waiver. Forms are also available in the Amherst Planning Department located in the lower level of the Amherst Municipal Building, 5583 Main Street, Williamsville, NY 14221.
There is no deadline for submitting a waiver application. Applications may be mailed or delivered at any time to:

The fee for a sidewalk waiver application is $100, payable to the Town of Amherst.

Per Local Law 14-2010 adopted 9/7/10, portions of the following roads do not require sidewalks:
- Campbell Boulevard
- Hopkins Road
- Millersport Highway
- New Road
- North Ellicott Creek Road
- Schoelles Road (entire road)
- South Ellicott Creek Road
- Sweet Home Road
- Tonawanda Creek Road
- Youngs Road
