To conduct a Going Out of Business Sale a fee of $500.00 must be submitted to the Town Clerk's Office. Please make 2 checks to the Town of Amherst. $75.00 is processed and $425.00 is held until the Building Department completes an inspection. Also required are a complete inventory, a floor plan, a statement that no goods are on consignment, and a statement that no goods listed in the inventory were the subject of a licensed sale conducted one year prior to the date of this application. The permit is valid for 30 days. To extend the permit for a consecutive 30 days, an additional $50.00 is required, but a new application is not necessary. Approximately $425.00 of the original deposit is refundable subsequent to an inspection conducted by the Building Department after the sale. A Going Out of Business Sale permit will be granted only once.
Fees are not refundable if the application is subsequently revoked or the store closes more than 60 days after the date of the license. If the business closes within the 60 days of the license, the fees, less $75, are refundable.
A statement must be filed with the Town Clerk at the termination of the sale indicating the total retail value of the disposed goods, prior to the refunding of the deposit.
